Bybit's own regulatory status and its rules for connecting an automated strategy or EA-style bot via API keys, straight from Bybit's terms and API documentation.

  • Bybit's main global platform (bybit.com) operates under a Seychelles/British Virgin Islands entity structure and is not licensed by a top-tier regulator such as the FCA or ASIC for most markets; its EU arm, Bybit EU GmbH, holds a MiCA CASP licence from Austria's FMA, and Bybit MENA holds a VARA licence for institutional services — coverage varies sharply by country, so check which entity actually serves your region.
  • Automated and API-based trading is explicitly supported: Bybit's API Key Documentation lets a user create keys with granular permissions (read-only, spot/derivatives trading, transfers), and a withdrawal permission that is separate and normally left disabled and IP-whitelisted — a bot connecting via API should only ever be given trading permission, never withdrawal.
  • Bybit's User Agreement makes the account holder solely responsible for actions taken through their API keys, including by any bot or third-party tool, and reserves the right to suspend accounts for abusive automated behaviour (e.g. market manipulation, excessive order rates).
  • The Risk Warning Notice underscores that derivatives and leveraged crypto trading carry a high risk of rapid loss and that automating a strategy does not reduce that risk — an EA still trades against the same volatile, largely unregulated crypto market.

  • Many exchanges sit outside deposit-insurance or investor-compensation schemes — funds held on an exchange carry custody and counterparty risk if it halts withdrawals or fails.
  • An exchange API key is a security surface: a leaked trade-only key can still be used to move your open positions, so scope, IP-lock and rotate it carefully.

  • Retail off-exchange forex dealers must register with the CFTC and be NFA Forex Dealer Members; soliciting retail forex orders — including for an automated system — requires NFA registration.
  • The SEC, NASAA and FINRA jointly warn that a phrase like “our proprietary AI system can't lose” signals an unregistered scheme, not legitimate automation.
